We reserve the right to suspend or terminate accounts where we reasonably believe a user is under 18 or has provided false information.

3. Nature of the Service

SpeakSmart AI provides digital products and AI-enabled services only. No physical goods are sold, and no physical delivery or shipping is involved.

The service may include audio recording, speech analysis, transcription, AI-generated feedback, educational suggestions, and related digital features.

4. Accounts

You may be required to create an account to access certain features.

You are responsible for:

• Keeping your login credentials confidential;
• All activity under your account;
• Notifying us promptly of any unauthorised access or security issue.

We may suspend or terminate access if we reasonably believe your account is being misused or used in breach of these Terms.

5. Acceptable Use

You agree not to:

• Use the service for unlawful, fraudulent, or abusive purposes;
• Upload content you do not have the right to use;
• Upload harmful, defamatory, threatening, discriminatory, or infringing material;

6. User Content

You retain ownership of your voice recordings and other content you submit.

You grant SpeakSmart AI a limited licence to use, host, reproduce, process, store, and display that content only to the extent necessary to operate, secure, maintain, and improve the service.

You are solely responsible for the content you upload and confirm that you have all necessary rights to provide it.

7. Intellectual Property

All intellectual property rights in the website, software, branding, AI workflows, text, graphics, design, features, and digital products belonging to SpeakSmart AI or its licensors remain our exclusive property.

Except as expressly permitted, you may not copy, reproduce, republish, distribute, modify, sell, license, reverse engineer, or commercially exploit any part of the service.

8. AI Output Disclaimer

SpeakSmart AI may generate automated outputs including transcripts, feedback, scoring, recommendations, and educational suggestions.

These outputs are generated using AI and automated systems and may not always be accurate, complete, available, or suitable for your particular goals. They are provided on an “as is” and “as available” basis for general informational use.

You should not rely on them as guaranteed results or as professional advice.

9. Service Availability

We aim to provide a reliable service, but we do not guarantee uninterrupted, error-free, or always-available access.

We may suspend, withdraw, update, change, or restrict all or part of the service for maintenance, security, technical, legal, or business reasons.

10. Fees and Digital Access

Where paid digital products, subscriptions, or paid access are offered, you agree to pay the fees shown at the time of purchase.

Access to digital content may begin immediately after purchase or activation. Once digital access, download, or use begins, refund and cancellation rights may be limited as described in our Refund Policy and as permitted by applicable law.

11. Statutory Consumer Rights

Nothing in these Terms excludes or limits any rights you may have under applicable consumer law.

UK consumer law treats certain pre-contract information as part of the contract and preserves statutory remedies for digital content and services.

12. Suspension and Termination

We may suspend, restrict, or terminate your access immediately if:

• You breach these Terms;
• You misuse the service;
• You engage in fraud, abuse, unlawful conduct, harassment, or infringement;
• Continued access presents security, legal, or operational risk;

13. Limitation of Liability

To the fullest extent permitted by law, SpeakSmart AI shall not be liable for any indirect, incidental, special, consequential, exemplary, or loss-of-profit damages.

Our total aggregate liability shall not exceed the amount paid for the relevant service in the previous 12 months, or £100 where no payment has been made.

Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold SpeakSmart AI harmless against claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of the service or breach of these Terms.

15. Changes to the Service or Terms

We may modify these Terms or the service from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Kingdom.

Any dispute arising out of or in connection with these Terms shall be subject to the courts of the relevant part of the United Kingdom.
